Terms of Service
These Terms of Service ("Terms") are a binding agreement between The Daily Permit ("Company," "we," "us," or "our") and you ("you" or "Customer"). These Terms govern your access to and use of TheDailyPermit.com (the "Site") and any data, information, reports, tools, analytics, and other materials made available through the Site (collectively, the "Services" and "Site Materials").
If you access or use the Services on behalf of your employer or another person or entity (a "Related Party"), you represent and warrant that you are authorized to bind that Related Party to these Terms. In that case, "Customer" includes both you and the Related Party.
1. Acceptance of These Terms
By accessing, viewing, registering for, purchasing, or using the Site or any Site Materials, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) to use the Services.
3. The Services
The Services provide access to certain Site Materials, which may include information received from third parties such as local governments ("Third-Party Data"). We may add, modify, suspend, or discontinue any part of the Services at any time.
4. Accounts, Logins, and Security
4.1 Account Registration
Some features require an account. You agree to provide accurate, current, and complete information and to keep it updated.
4.2 Login Credentials Are Personal and Non-Transferable
Outside of any freely available sample content, access typically requires a user-specific login ("Login") and/or an active subscription ("Subscription"). Your Login and Subscription access are strictly personal to you and may not be shared, transferred, resold, sublicensed, or assigned to any other person or entity.
4.3 You Are Responsible for Your Account
You are responsible for all activity that occurs under your Login. Notify us immediately of any suspected unauthorized access or security breach at support@thedailypermit.com. You are responsible for maintaining the confidentiality of your credentials.
5. Subscriptions, Billing, Renewal, Cancellation, and Refunds
5.1 Subscription Terms
If you purchase a Subscription, plan details (including pricing, term, included usage, renewal, and any plan-specific terms) will be provided in your subscription confirmation email or billing confirmation letter (the "Subscription Confirmation"). If there is a conflict between these Terms and your Subscription Confirmation about billing or term specifics, the Subscription Confirmation controls.
5.2 Auto-Renewal
Unless otherwise specified in your Subscription Confirmation, your Subscription will renew automatically for successive terms unless you provide notice of termination at least 30 days prior to the end of the then-current term.
5.3 Usage Limits and Plan Enforcement
Your plan may include limits on reports, credits, searches, downloads, or other usage metrics. We may review usage patterns and enforce plan limits.
If your usage significantly exceeds your plan limits within a billing month or repeatedly over multiple months, we may contact you to discuss an upgrade. If we cannot agree on an appropriate access level, we may suspend or terminate your access as described below.
5.4 Cancellation
You may cancel your account at any time via your account management page (if available) or by contacting support@thedailypermit.com. Cancellation generally prevents future renewals but does not automatically guarantee a refund except as expressly stated in these Terms or your Subscription Confirmation.
5.5 Refunds
If you believe a report was not useful, you may request a refund by canceling and contacting support@thedailypermit.com. Refunds (if any) are handled in accordance with these Terms and your Subscription Confirmation.
5.6 Termination by Company; Pro-Rated Refund (If Applicable)
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected misuse or violation of these Terms.
If we terminate your paid Subscription without cause, we will provide a refund equal to the base amount paid minus a pro-rated amount for time used, rounded up to the nearest month (unless otherwise stated in your Subscription Confirmation or prohibited by applicable law).
6. Ownership, Intellectual Property, and License
6.1 Company Ownership
The Site and all Site Materials (including all databases, structure, format, delivery options, filters, indicators, analytics, text, graphics, and compilation) are owned by the Company or licensed to the Company and are protected by U.S. and international intellectual property laws.
Except for the limited rights granted below, the Company retains all right, title, and interest in and to the Services and Site Materials.
6.2 Limited License to You
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services and Site Materials for your internal business purposes during your active Subscription term (or as otherwise permitted by your plan).
6.3 Restrictions
You agree you will not, and will not allow any third party to:
- Copy, reproduce, distribute, publish, sell, resell, display, transmit, license, rent, lease, or otherwise make Site Materials available to others except as expressly permitted by these Terms.
- Remove or alter any copyright, trademark, or other proprietary notices.
- Reverse engineer, decompile, disassemble, or attempt to discover source code, underlying methods, models, or algorithms.
- Scrape, crawl, harvest, or use automated means to access the Services except as expressly authorized by us in writing.
- Circumvent access controls, security measures, or usage limits.
- Use the Services to develop, offer, or provide a product or service substantially similar to or competitive with the Services based on access to the Site Materials.
7. Confidentiality
Except for any freely available sample content, the Site Materials (including the structure, format, delivery options, filters, indicators, and analytics) are confidential. You agree to protect them using reasonable safeguards and to use them only as permitted by these Terms.
8. Acceptable Use; Prohibited Conduct
You agree not to use the Services:
- For any unlawful purpose, or in violation of any applicable law or regulation.
- To facilitate harmful, abusive, harassing, discriminatory, deceptive, or "predatory" activity (including stalking, intimidation, or unlawful targeting).
- In any manner that interferes with or disrupts the Services, systems, or networks.
- To access or attempt to access data you are not authorized to access.
If we detect misuse, we may suspend or terminate your account and access. To the maximum extent permitted by law, if your account is terminated for misuse, we may deny refunds.
9. Third-Party Data; Corrections; Models and Outputs
9.1 Third-Party Data
Some Site Materials include Third-Party Data, including information received from local governments. We do not control Third-Party Data and are not responsible for inaccuracies, delays, omissions, or errors originating from third parties.
9.2 Corrections Must Be Made by the Source
If Third-Party Data is inaccurate, corrections typically must be made by the applicable third-party authority. We generally do not have authority or ability to change official third-party records. Updates may not appear in our Services unless and until the source updates its records.
9.3 Illustrative Outputs; No Prediction
Any analyses, opinions, estimates, ratings, scores, or similar outputs provided through the Services are for informational and illustrative purposes only and should not be interpreted as statements of fact or predictions of any particular event, condition, or risk.
We may use models and algorithms that rely on inputs, assumptions, and methodologies that may change over time at our discretion without notice.
10. Fair Credit Reporting Act (FCRA) and Prohibited FCRA Uses (Important)
You acknowledge and agree:
- The Company is not a "consumer reporting agency" as defined under the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq.
- The Services and Site Materials are not intended to constitute "consumer reports" under the FCRA.
- You may not use the Services or Site Materials, in whole or in part, to make decisions about an individual for any purpose regulated by the FCRA or similar state laws, including (without limitation):
- employment, hiring, promotion, reassignment, or retention;
- tenant screening or housing eligibility;
- credit, insurance, or financing eligibility; or
- any other purpose that would require a "consumer report" or impose obligations under the FCRA.
You are solely responsible for complying with all applicable laws and regulations. The Company is not liable for your failure to comply with the FCRA or other laws, even if such non-compliance results from your use of or reliance on the Services.
11. Disclaimers
THE SERVICES AND SITE MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE."
To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted, timely, secure, or error-free operation. The Site and Site Materials may change at any time without notice.
You assume all risk arising from your interpretation or use of the Site Materials.
12. Limitation of Liability
To the maximum extent permitted by law:
- The Company will not be liable for any indirect, incidental, special, consequential, exemplary, tort, economic, cover, or punitive damages, or for loss of profits, business, goodwill, data, or programs, arising out of or relating to these Terms or your use of (or inability to use) the Services, even if advised of the possibility of such damages.
- If liability cannot be excluded, the Company's total liability for any claim arising out of or relating to the Services will not exceed the lesser of $5,000 or the amount you paid to the Company for the Services in the six (6) months prior to the date the claim arose.
You acknowledge these limitations are fair and reasonable.
13. Indemnification
You will indemnify, defend, and hold harmless the Company from and against any and all claims, suits, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:
(a) your (or any third party's) use of or reliance on the Services or Site Materials;
(b) your breach of these Terms; or
(c) your violation of any law or regulation, including the FCRA.
14. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
14.1 Informal Resolution First
Before filing a claim, you agree to try to resolve disputes informally by emailing support@thedailypermit.com with the subject line "Notice of Dispute" and a brief description of the issue and requested relief. We will attempt to resolve the dispute in good faith. If the dispute is not resolved within 30 days, either party may proceed as described below.
14.2 Agreement to Arbitrate
Except as stated in Section 14.3, you and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules (including consumer or commercial rules, as appropriate), and judgment on the award may be entered in any court of competent jurisdiction.
The arbitration will be conducted in Buncombe County, North Carolina, unless the parties agree otherwise, and may be conducted by video, phone, or written submissions where permitted by the AAA rules.
This arbitration agreement is governed by the Federal Arbitration Act (FAA) to the maximum extent permitted by law.
14.3 Exceptions
Either party may:
- bring an individual claim in small claims court if it qualifies; and/or
- seek injunctive or equitable relief in court for the unauthorized use, copying, misuse, or infringement of intellectual property or confidential information.
14.4 Class Action Waiver
You and the Company agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding. The arbitrator may not consolidate claims or award relief on a class or representative basis.
14.5 Arbitration Fees and Costs
Payment of arbitration fees will be governed by the AAA rules and applicable law. Each party will bear its own attorneys' fees and costs unless the arbitrator awards otherwise under applicable law.
14.6 Opt-Out
You may opt out of arbitration by sending an email to support@thedailypermit.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out" and including your name, the email address associated with your account, and a clear statement that you wish to opt out. If you opt out, Section 16 (Governing Law and Venue) will apply.
14.7 Severability of This Section
If any part of this arbitration/class waiver section is found unenforceable, the remainder will remain in effect, except that if the class action waiver is found unenforceable, the arbitration agreement will not apply to that dispute.
15. Remedies; Injunctive Relief
You agree that a breach of these Terms may cause irreparable harm to the Company. The Company may seek injunctive or equitable relief to prevent or stop breaches without posting bond or proving actual damages, in addition to any other remedies available at law.
If the Company successfully enforces these Terms, you agree to reimburse the Company for reasonable enforcement costs and attorneys' fees.
16. Governing Law; Venue (When Arbitration Does Not Apply)
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.
If a dispute is not subject to arbitration (or if you timely opt out of arbitration), the exclusive venue and jurisdiction for any dispute arising out of or relating to these Terms or the Services will be the U.S. District Court for the Western District of North Carolina or a court of competent jurisdiction located in Buncombe County, North Carolina. Each party consents to personal jurisdiction and waives objections to venue in those courts.
17. Reports Provided to Your Clients
If you provide any reports included in the Site Materials to your clients, you agree and warrant that you will include terms and conditions in your client agreements that are at least as protective of the Company as these Terms, including disclaimers and limitations of liability.
You will indemnify, defend, and hold harmless the Company from and against any and all claims, damages, and expenses (including attorneys' fees) arising out of or relating to (i) any breach of your obligations under this section, and (ii) your client's use of any report or information contained in the Site Materials.
18. Feedback
If you provide suggestions, ideas, or feedback about the Services ("Feedback"), you grant the Company a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate the Feedback into the Services without compensation or attribution.
19. Copyright and DMCA Notice (If Applicable)
We respect intellectual property rights. If you believe material on the Site infringes a copyright you own or control, you may submit a written notification to us at support@thedailypermit.com with the subject line "DMCA Notice."
Your notice should include:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (such as a URL).
- Your contact information (name, address, telephone number, and email address).
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
If you believe content was removed or disabled by mistake, you may send a counter-notice to the same email address with the subject line "DMCA Counter-Notice" and include the information required under the DMCA.
20. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date indicates when the Terms were most recently revised. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
21. Miscellaneous
- Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
- Entire Agreement. These Terms and any Subscription Confirmation constitute the entire agreement regarding the Services and supersede prior agreements on that subject.
- No Waiver. Failure to enforce any provision is not a waiver.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
- Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.
- Electronic Communications. By using the Services, you consent to receive communications from us electronically (e.g., by email or posting on the Site).

Privacy Policy
This Privacy Policy explains how The Daily Permit ("Company," "we," "us," or "our") collects, uses, shares, and protects information about users of our Site and Services.
We do not sell Personal Information and we do not share Personal Information for cross-context behavioral advertising (targeted advertising).
1. Information We Collect
We collect information in three main ways: (a) information you provide, (b) information collected automatically, and (c) information from service providers.
1.1 Information You Provide
When you register, subscribe, contact support, or use the Services, you may provide:
- Name, email, phone number, and mailing address
- Account credentials (username and password)
- Billing-related details (billing address and payment status information)
- Customer support communications and feedback
1.2 Payment Information
We use a third-party payment processor ("Payment Processor") to process payments. We do not store full credit or debit card numbers on our servers. Payment information is handled by the Payment Processor under its own terms and privacy policy.
1.3 Information Collected Automatically
When you use the Site, we may automatically collect:
- IP address and approximate location (derived from IP)
- Browser/device information (device type, operating system, browser type)
- Log data (pages viewed, time stamps, referring/exit pages, clicks)

3.1 Service Providers

3.2 Business Transfers

3.4 No Sale of Personal Information; No Targeted Advertising

We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and for legitimate business purposes.
Even after you update or delete information or cancel your account, copies may remain in backups and archives for a period of time, as permitted by law.

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
7.1 Breach Notification
If legally required, we will notify you of a breach of certain personal data as required by applicable law, and we may do so by email or conspicuous posting on the Site.
8. Your Choices and Access
You may be able to review, update, correct, or delete certain Personal Information in your account profile. You may request account cancellation by contacting support@thedailypermit.com. We will try to accommodate requests unless we must retain information for legal compliance or legitimate business purposes.
9. Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If we learn that we have collected such information, we will delete it.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post updates on this page and update the "Last Updated" date. Changes are effective when posted.

U.S. State Privacy Notice (California and Other U.S. State Laws)
This section supplements the Privacy Policy for residents of certain U.S. states that provide privacy rights (including, for example, California). This notice describes (1) the categories of Personal Information we collect, (2) how we use and disclose it, and (3) how you can exercise applicable rights.
For purposes of this section, "Personal Information" includes "personal data" or similar terms as defined by applicable state law.
A. Categories of Personal Information We Collect
Depending on how you interact with us, we may collect the following categories:
- Identifiers (e.g., name, email address, IP address)
- Customer records (e.g., billing address, account information)
- Commercial information (e.g., subscription status, transaction history)
- Internet/network activity (e.g., pages viewed, usage logs, interactions with the Site)
- Approximate location data (e.g., inferred from IP address)
We do not intentionally collect sensitive government identifiers (such as Social Security numbers) as part of normal account registration.
Sensitive Personal Information (California). We may collect limited "sensitive personal information" as defined by California law (for example, account log-in credentials). D. How We Disclose Personal Information
- Service providers that help us operate the Services (hosting, analytics, customer support, payment processing, email delivery)
- Legal and safety recipients as needed to comply with law or protect rights and safety
- Business transferees in connection with corporate transactions
E. "Sale," "Sharing," and Targeted Advertising
We do not:
- sell Personal Information, or
- share Personal Information for cross-context behavioral advertising (targeted advertising).
If our practices change, we will update this notice and describe any opt-out rights that may apply.
F. Your State Privacy Rights
Depending on your state of residency and subject to legal limitations, you may have the right to:
- Access/Know: request information about the Personal Information we collected about you
- Delete: request deletion of certain Personal Information
- Correct: request correction of inaccurate Personal Information
- Portability: request a copy of certain Personal Information in a portable format
- Opt out: opt out of certain processing such as targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects (note: we do not sell or engage in targeted advertising as described above)
We will not discriminate against you for exercising your rights.
G. How to Submit a Privacy Rights Request
To submit a request, email support@thedailypermit.com with the subject line "Privacy Rights Request" and include: your name; the email address associated with your account; the state where you reside; and the specific right you want to exercise (access, delete, correct, portability, etc.).
Verification. To protect your information, we may need to verify your identity before processing your request. Verification may require you to confirm account details or take additional steps consistent with applicable law.
Authorized Agents (California). If you use an authorized agent to submit a request on your behalf, we may require proof of the agent's authorization and may also require you to verify your identity directly with us.
H. Appeals (Certain States)
If we deny your request and you are entitled to an appeal under your state's law, you may appeal by replying to our decision email and stating that you would like to appeal. We will respond within the timeframe required by applicable law.
I. California "Shine the Light"
California residents may request certain information about disclosures of Personal Information to third parties for their direct marketing purposes. We do not share Personal Information with third parties for their own direct marketing purposes in a manner that would trigger "Shine the Light" disclosures.
